Draft Authorization: I authorize the billing agency for Iron2 Fitness to debit entries to my account as indicated.

NOTICE: State law requires that we inform you that should you (the buyer) choose to pay for any part of this agreement in advance, be aware that you are paying for future services and may be risking loss of your money in the event that Iron2 Fitness ceases to conduct business. Iron2 Fitness does not post a bond, and there may be no other protections provided to you should you choose to pay in advance.

IRON2 FITNESS IS AN INDEPENDENTLY OWNED AND OPERATED FACILITY.

NO ONE UNDER THE AGE OF 14 IS ALLOWED IN THE GYM FACILITY.  MEMBERS BETWEEN THE AGE OF 14 AND 15 MUST BE ACCOMPANIED BY A PARENT OR GUARDIAN.

 A PAID MEMBERSHIP IS REQUIRED TO USE THE GYM FACILITY AND ALL MEMBERS MUST USE THE KISI APP TO ACCESS THE GYM FACILITY.  NO TAILGATING IS ALLOWED.  DUE TO LIABILITY CONCERNS, ANY VIOLATION OF AGE OR TAILGATING RULES WOULD BE GROUNDS FOR IMMEDIATE TERMINATION OF MEMBERSHIP WITHOUT REFUND.  

The undersigned, for himself/herself, and/or on behalf of member acknowledges that he/she understands the risk of injury inherent in any vigorous physical activity and assumes such risk. The undersigned certifies that he/she has been urged to consult a physician about any special condition which would make member unusually susceptible to injury and immediately advise Iron2 Fitness of any such condition in writing. All members training equipment must be Iron2 Fitness and approved for insurance liability purposes.

The undersigned certifies that he/she knows of no physical condition which would make the member unusually susceptible to physical injury. The undersigned for himself/herself, and/or on behalf of member hereby waives any claims against , its' officers, directors, instructors or agents arising directly or indirectly from any injury suffered by member at the Iron2 Fitness facility or during any sponsored Iron2Fitness event, other than injuries resulting from the willful misconduct of Iron2Fitness officers, directors, instructors, trainers, contractors, or agents.

The undersigned certifies that he/she has explained to the member, in terms that member can understand, the vital importance of following the rules established for members by Iron2 Fitness and agrees to indemnify and save harmless Iron2 Fitness, its' officers, directors, instructors, trainers, contractors,  and agents from any loss, liability, suit or claim arising directly or indirectly from member failing to abide by said rules.

Any holder of this consumer credit contract is subject to all claims and defenses which the debt collector could assert against the seller of goods or services obtained pursuant hereto or with the proceeds hereof, recovery here under by the debtor shall not exceed amounts paid by the debtor here under.

Under this contract, no further payments shall be due to anyone, including any purchaser of any note associated with or contained in this contract, in the event that the location at which the contract in entered into ceases operation and fails to offer an alternate location, substantially similar, within ten miles.

You (the buyer) have seven business days to cancel this contract. To cancel, mail or hand deliver a letter to the location address listed at the top of the first page of this document.

MONTH-TO-MONTH DISCLAIMERS:

MEMBERS WHO CHOOSE THE MONTH TO MONTH OPTION MUST PROVIDE 30 DAYS NOTICE OF CANCELLATION BY COMPLETING THE OFFICIAL Iron2 Fitness CANCELLATION FORM*. IF THERE IS A PAYMENT SCHEDULED WITHIN THE 30-DAY CANCELLATION WINDOW, IT WILL BE DRAFTED PRIOR TO CLOSING THE ACCOUNT.

*OFFICIAL CANCELLATION FORMS MAY BE OBTAINED AT YOUR TRAINING LOCATION

VALUE PLAN / PAID-IN-FULL DISCLAIMERS:

THERE ARE NO REFUNDS OR CANCELLATIONS AVAILABLE FOR PAID IN FULL AGREEMENTS DUE TO THE SAVINGS OFFERED FOR THOSE OPTIONS. THE ONLY INSTANCES WHERE CANCELLATIONS ARE ALLOWED ARE LISTED BELOW:

 IF BY REASON OF DEATH OR PERMANENT DISABILITY, THE MEMBER IS UNABLE TO COMPLETE THE TRAINING PROGRAM, HE/SHE AND HIS/HER ESTATE SHALL BE RELIEVED FROM THE OBLIGATION OF MAKING PAYMENT FOR TRAINING OTHER THAT RECEIVED PRIOR TO DEATH OR THE ONSET OF DISABILITY WITH A FINAL PAYMENT OF $150.00

FOR CANCELLATION, COMPLETION OF THE OFFICIAL CANCELLATION FORM AND UPON PROVIDING LEGITIMATE DOCUMENTATION VERIFYING SAID DEATH OR PERMANENT DISABILITY, AND THAT IF HE/SHE HAS PREPAID ANY SUM FOR TRAINING, SO MUCH OF THAT SUM AS IS ALLOCABLE TO TRAINING HE/SHE IS NOT ABLE TO TAKE DUE TO DEATH OR DISABILITY, SHALL BE PROMPTLY REFUNDED.

FOR MEMBER(S) WHO PERMANENTLY MOVE THEIR RESIDENCE MORE THAN 25 MILES FROM AN AFFILIATED AREA, PAYMENT ON THIS AGREEMENT SHALL BE SUSPENDED UPON COMPLETION OF OFFICIAL CANCELLATION FORM, PAYMENT OF APPROPRIATE CANCELLATION FEE OF $150.00 AND UPON PROVIDING LEGITIMATE VERIFICATION OF MOVE. LEGITIMATE VERIFICATION OF MOVE CONSISTS OF A COPY OF A NEW SIGNED LEASE AGREEMENT OR MORTGAGE AGREEMENT, CHILD'S SCHOOL REGISTRATION OR A COPY OF A NEW UTILITY BILL LISTING THE NEW ADDRESS. DRIVER'S LICENSE OR PASSPORT COPIES WILL NOT BE ACCEPTED.

ANY REFUNDS FOR PREPAID TUITION FOR THESE TWO REASONS WILL BE CALCULATED TO DEDUCT THE TIME IN TRAINING PRIOR TO CANCELLATION AT THE MONTH TO MONTH RATE WITH THE BALANCE ISSUED AS A REFUND.

*OFFICIAL CANCELLATION FORMS MAY BE OBTAINED AT YOUR TRAINING LOCATION

You (the buyer) may cancel this agreement within 30 days from the time you knew or should have known of any substantial change in the services or programs available at the time you joined. Substantial changes include, but are not limited to, changing from being coed to being exclusively for one sex and vice versa. To cancel, send written notice of your cancellation to the address provided in this statutory overnight delivery, return receipt requested.

By completing this agreement, I am acknowledging:

• MONTH-TO-MONTH: The terms of cancellation have been thoroughly explained to me, and I fully understand that these are the only terms of cancellation for this agreement. I must provide 30 days’ notice of cancellation. If there is a payment scheduled within the 30-day cancellation window, it will be drafted prior to closing the account.                           

• VALUE / PAID-IN-FULL: The terms of cancellation have been thoroughly explained to me, and I fully understand that these are the only terms of cancellation for this agreement. The Paid-in-Full and Value plans have no cancellation option.

Liability Release & Waiver Agreement

I, the undersigned (or parent or legal guardian if participant is a minor) warrant and represent that I am in appropriate physical condition to participate in gym activities managed by Iron2 Fitness. I understand that all activities, including but not limited to use of free weights, machines, cardiovascular equipment, group exercise classes, personal training sessions, sauna and red light therapy, tanning, and related programs, carry inherent risks. These risks include muscle strains, joint injuries, slips and falls, cardiovascular events, equipment malfunction, and serious injury or death. By voluntarily submitting my application for membership, I do hereby certify that I am fully aware of and understand the inherent dangers associated with my continued participation, including but not limited to use of free weights, machines, cardiovascular equipment, group exercise classes, personal training sessions, sauna and red light therapy, tanning, and related programs, and I certify I, or my minor child, am physically capable of participating, and have no medical or physical conditions that would preclude participation.  I knowingly and voluntarily assume all risk described herein, and I understand and agree that the operators of Iron2 Fitness, its owners, instructors, and other participants will not be responsible for my safety.

I understand and agree that in consideration of being allowed to participate in gym activities, I hereby knowingly and voluntarily assume any and all risks involved in connection with gym activities. Furthermore, I agree to release and hold harmless the owners, trainers, employees, and contractors, including but not limited to Iron2 Fitness, their agents or assigns, and any other individual or entity associated with gym activities from any and all liability for bodily injury and/or property damage, whether due to seen or unforeseen actions arising out of my participation in activities; including harm, injury, or damage, whether or not due to negligence or intentional acts of others, that may occur to me or befall me, my family, descendants, heirs or assigns while participating in gym activities.

I am fully aware of the risks and hazards associated with utilizing the equipment and facilities. I knowingly and voluntarily assume all risks for any injury, up to and including death, that may result from my use of the equipment and facilities. I waive any and all liability for any personal injury related to my use of the equipment and facilities.

I am competent to sign this agreement for myself or on behalf of my minor child, I am signing this agreement of my own free will, and I understand and agree that the terms herein are contractual and they are not mere recital or simply for informational purposes. I have read, understood, and been fully informed of the contents of this agreement. I assume sole responsibility for my physical condition and capabilities. I understand it is my responsibility to consult a physician before engaging in gym activities. I understand that Iron2 Fitness is complying with guidelines regarding limiting the spread of COVID-19 virus but that is in no way a guarantee that I will not be exposed to the COVID-19 virus while in a facility managed by Iron2 Fitness.

I hereby consent to the use of photographs of my image or that of my minor child by Iron2 Fitness. I grant Iron2 Fitness the right to use my image or likeness in such images or photographs in any advertising, promotion, marketing materials, or live video streaming including but not limited to any and all social media, print media, or website.
